The importance of patent protection

If you are a New Jersey inventor, you know how important it is for you and your company that you obtain patent protection for your intellectual property. You likely already know as well that when you register a patent with the United States Patent and Trademark Office, the exclusive rights that you obtain only cover the United States and territories such as Puerto Rico and Guam. However, there are other types of protections that cover other countries.

At our law firm, we have extensive experience in assisting clients who plan on marketing or licensing their product overseas. More than 130 countries are signatories to the Patent Cooperation Treaty. This agreement gives priority rights to inventors who have filed an international patent application in one or more of those countries, including the United States. We can assist you in preparing and then filing such an application with the USPTO. The application will include the names of the signatory countries in which you plan on seeking protection in the future.

While you will still have to apply in each of those countries, an international application provides you with a few benefits. One of the chief ones is that you are given more time to file in the targeted country. Another is that you are given priority over certain foreign filings.

Another avenue for foreign filings is the Patent Prosecution Highway program, which fast tracks applications made in other countries such as Japan and China and that we can explain in more detail.
